TERMS OF SALE
The following Terms of Sale apply to sales at www.bjornborg.com (”the Web Shop”) with the exception of US sales. You are instructed to read these Terms of Sale before placing any orders. By approving an order, you confirm that you accept these Terms of Sale. These Terms of Sale may be updated by Björn Borg in the future. For the Terms of Sale regarding our US webshop, please visit the US shop.
The Web Shop is intended for sales to consumers only. If you are below the age of 16 you must gain parental approval before submitting any order through the Web Shop. A binding purchase agreement is concluded when your order have been confirmed by us (Order Confirmation).
On rare occasions a certain product may run out of stock. If the missing item will not be replenished, the customer will be notified as soon as possible. Björn Borg may have to cancel part of or the entire order. Björn Borg reserves the right to cancel an order if fraud or similar activity, such as unauthorized use of another’s credit card, is suspected.
PRICE & PAYMENT
The prices at the Web Shop are current prices and may be changed at any time. Björn Borg is not bound by price indications in the Web Shop which the buyer must reasonably or apparently understand are incorrect and which, for example, have occurred due to technical problems in the web platform or rates that have been manipulated by the customer. Any orders hereby can systematically be cancelled. Payment can be made by credit card, direct debit, invoice or as may otherwise be instructed at the Web Shop. Where payment is subject to validation and/or authorisation by a card issuer or bank or to credit validation, any Order Confirmation is subject to such validation or authorisation. We co-operate with an authorized payment service provider (Klarna), who processes your personal details in accordance with the international security standard PCI DSS, developed by international credit card companies such as VISA, MasterCard etc. All transactions will be sent through SSL (Secure Sockets Layer) in encrypted form and all card details and payment information will be protected and processed with a high level of security. At this moment we offer payment with invoice/pay after delivery to Sweden, Norway, Finland, Holland, Germany, Austria and UK. In Sweden and Finland we support local banks. In Germany and Austria we support SOFORT as well as Lastschrift. Payments with SEPA and iDEAL are supported in Holland.

Björn Borg has chosen to put the safety of our customers in the hands of the experts, Klarna. Our access to sensible information is therefore very limited. For questions regarding payments we kindly ask you to contact Klarna.
TAXES & DUTIES
On all orders from within the European Union prices include local VAT and are payable in the currency indicated at the Web Shop. These orders will be shipped on a DDP (Delivery Duty Paid) basis, meaning that all taxes and duties are included in the price at checkout. Payment of any duties and taxes is the responsibility of the recipient and will not be refunded or compensated by Björn Borg.
Rest of the World
Your order is shipped on a DDU (Delivery Duty Unpaid) basis, which means that the price payed at checkout are exclusive of all taxes and duties as well as Swedish VAT. International orders can incur taxes and duties as determined by the customs agency within the destination country. This is not uncommon when shipping to a non-EU country. Although this does not always occur, assessment of duties and taxes will be based on the value of the order and the Tax-free threshold (if it exists) for goods imported into the destination country. Occasionally this may be listed as an additional postage fee. While we apologize for any inconvenience, we have no control over such fees. Payment of any duties and taxes is the responsibility of the recipient and will not be refunded or compensated by Björn Borg. PROMOTIONS & DISCOUNT CODES
On orders eligible for a gift or discount the value of the gift/discount is considered as a general discount on the total amount of the order. If part of or the entire order is sent back for exchange or refund the value of the returned merchandise is recalculated and the purchase price minus the relative share of the overall discount will only be credited.
Promotions and discount codes are only valid on new orders and cannot be applied retrospectively.
We always aim at delivering your order as soon as possible. Normally orders of items in stock ship within 1-2 business days from Order Confirmation and can be expected to be delivered to you within five to ten business days. Delivery times are estimates only and particularly during high season (e.g. Christmas) deliveries may take longer than normal. In case of a delay in delivery of more than fifteen (15) business days beyond the estimated delivery time above, you may cancel your order subject to written notice to us, in which case we will, as our entire liability for the delay, credit any payment made by you. If the order has already shipped, you must first return the item to us before such credit can be made. The freight cost will be specified in the order summary before you submit your order. We currently ship to most countries but may not ship to certain countries outside the European Union. Should you have an inquiry as to whether or not we ship to a specific location, please contact our Customer Service. Please be advised that custom duty may be charged for any orders from outside the European Union. For orders from and shipments to the US, please refer to our separate US Web Shop. You are asked to inspect delivered items upon delivery and report any deviations found as stated under Returns below. In case you fail to collect your products upon delivery, we reserve the right to debit you a charge to cover our cost for return freight and administration.
RIGHT OF WITHDRAWAL AND RETURNS
We offer you a “no questions asked” 30-day right-of-withdrawal from your purchase, calculated from the date you order the goods. If you wish to make such a return please follow our. Items shall be returned here under properly wrapped and packed in their original packaging in an unused and saleable condition. We do not accept returns of underwear and swimwear, unless the underwear or swimwear is in its original sealed wrapping (i.e. you may not remove the seal if you wish to return these products).
As soon as we have received the returned items, and have been able to confirm that the requirements above are met, we will refund your payment. In case you find that an item delivered by us to you is defective you should contact Customer Service as soon as possible with a formal complaint, to get a replacement delivery or, if that is not possible, a refund. The same applies in case you identify that a product has been damaged during transportation or you identify other deviations in the delivery, e.g. that the number of items or the product model delivered is not in line with your order. Returns here under shall be sent toor to the other address specifically instructed by us. If we have included a return form in your delivery you should use such return form. In case of a return the risk (for loss or damage during delivery) is on the customer. Items purchased at the Web Shop cannot be returned in or through any physical Björn Borg Store.
By submitting an order at the Web Shop you consent to us processing your personal data. Your purchase may involve the collection and processing by us, or by a sub-contractor of us, of your personal data, for example of the data you fill out in the order form, including your civic registration number as the case may be, or the personal data processing that may be necessary to execute your payment. We will use your personal data to manage your purchase (including with respect to payment, delivery and any returns and/or refunds), for marketing purposes and to improve the services and design of the Web Shop. Your personal data may be transferred by us to another company of our company group and/or to certain selected third parties involved in e.g. payment transactions or deliveries, some of which may be located outside the European Union (and which may therefore involve transfer of data to such non-EU countries), but then only to meet our commitments to you in connection with your purchase. We reserve the right to submit your personal data, in whole or in part, as may be required following a mandatory order of the police or prosecutor’s office or by a court of competent jurisdiction or another government agency having appropriate authority, including for the investigation of (suspected) fraud or other crime against you or a third party. Such disclosure will be limited to personal data that are relevant and/or necessary to meet such request and we will do our best to keep you properly informed of any such disclosure.
Your personal data will be stored only for as long as is needed or for as long as is provided by law. Upon your request, we will tell you which personal data about you we are processing and for what purpose(s) and you may request that your personal data is corrected or removed. In case you wish to be removed from any direct mailing lists, please contact our Customer Service. We will not sell your personal data to any third party for such third party’s marketing campaigns or for any unsolicited marketing unrelated to your purchase(s) at the Web Shop.
Certain products referred to at the Website may not be available in your country. Please contact your local store or distributor for more details about what products are available in your country (please refer to our Store Locator and/or Distributor list at the Website). We disclaim liability for any apparent typos on the Website. While we aim at providing as accurate as possible descriptions and images on the Website, there may be minor colour variations between the images and the actual products sold by us, due to a number of factors such as the colour contrast configurations of your internet browser or computer monitor. All pictures are therefore to be seen as illustrations and are not guaranteed to reproduce the exact appearance of a product.

TERMS OF LOYALTY PROGRAM
The Team Borg Loyalty Program (the“Program”) is designed to help you get the most out of your membership. These Program terms and conditions (the “Program Terms and Conditions”) contain important information regarding the Program. Please read the following Program Terms and Conditions carefully.
1.1 The Program is offered at the sole discretion of Björn Borg. (“Björn Borg,” “we,” “our” or “us”). The Program is available to individuals aged at least 16, for their personal use only and is limited to one account per individual. The Program may not be used for any business or commercial purpose. Björn Borg may in its sole discretion refuse to create an account for any reason.
2. PROGRAM ENROLLMENT
2.1 Individuals fulfilling all the requirements specified in section 1 (Membership) may enroll in the Program by creating a personal account at www.bjornborg.com, hereinafter the “Site”).
2.2 When signing up for the Program and creating your personal account, you will be required to provide your email address, name and create a password. You are solely responsible for maintaining the accuracy of your account information and for updating it as required.
2.3 Only one Program account may be associated with a single email address. In the event of a dispute over ownership of the Program membership account, the member will be deemed to be the authorized account holder of the email address submitted at the time of enrollment.
2.4 The program is available in SEK and the Swedish market.
3. HOW THE PROGRAM WORKS
3.1 The Program is a way in which we reward and thank our loyal customers for purchasing our products and for participating in certain brand experiences on the Site. You are able to earn points and reach Program loyalty tiers by making eligible purchases or taking certain other Program actions. Once you earn points and reach a certain loyalty tier, you may be eligible for certain benefits and rewards applicable to that tier, which benefits may change from time to time and may be offered on a limited basis. Eligible purchases and other opportunities to earn points and reach Program loyalty tiers will be posted on the Site or may be published through other media (e.g., in marketing communications, social media, etc.). 3.2 The Program is a tier-based program determined by the number of points a member has earned on eligible purchases and through qualifying activities, beginning on the date when you enroll. There are 3 tiers with associated benefits:

5 000 - 14 999 points
Level 3, Legend
15 000 + points
3.3 Members receive 1 points for 1 SEK spent on purchases at www.bjornborg.com. The program may be available for in store purchases in such stores and in such countries as Björn Borg may decide from time to time. Eligible purchases include regular priced merchandise (unless otherwise specified by us) and exclude eGift Cards, shipping and delivery charges, and/or other excluded charges specified by us from time-to-time. All points earned from purchases on the Site are pending until your order ships, at which point they are fully matured and capable of redemption.
In addition to these purchases, you may also earn points for the following actions on the Site. To earn points, please check to make sure you are a Program member and you have logged into your account before completing the actions below. The number of points, if any, awarded for each action is determined by Björn Borg in its sole but reasonable discretion and in all cases subject to a maximum number of points earned for each action per year.
Program members who make no qualifying purchases or activity during any continuous (rolling) 24-month period, will have their membership automatically terminated on the last day of the 24th month of account inactivity and the account will be deactivated.
4. PROGRAM BENEFITS & REWARDS
As a member, you earn points that determine your points benefits and tier levels and tier benefits. To redeem offers and rewards, you must have accumulated the minimum number of points as established by us for a particular benefit. Product rewards and samples are shipped with product purchases on the Site only. Points may never be exchanged for cash. You must be logged in to your Program account to use your benefits. You will find your eligible offers and rewards (with offer codes if applicable) listed in your personal account. Qualifying members will receive email invitations when event rewards are available if they have not opted-out of receiving Program emails.
4.1 Point benefits: At different point levels you will unlock rewards that can be used in conjunction with a purchase on the Site and in store (if the Program is available in the relevant store) You must redeem your unlocked rewards prior to 24 months after earning them, or the available rewards will expire. After 24 months, your points reset to zero.
4.2 Tier benefits: Certain benefits are based on tier level achieved and you are eligible for these benefits while you are in that tier regardless of the number of points you currently have. Tier benefits can only be redeemed on the Site with the exception of exclusive in-store member events and VIP events or as otherwise noted. As stated above, earned points will be reset to zero unless the points are used within 24 months from earning the points. Even though your points reset to zero, your initial tier status for the year is determined by the number of points earned in the prior year.
4.3 Birthday benefits: During the month of your birthday, you can redeem your Birthday Gift on the Site with a purchase and by providing your offer code, which will be visible within your account profile if you have provided your birth date. You must be logged into your Program account to redeem your Birthday Gift. There is a limit of one Birthday Gift per member per year.
4.4 Offers & Rewards are available while supplies last and substitutions made by us in our sole discretion may occur. If your online order is not completed for any reason, any offers or rewards will be removed from your shopping basket and may no longer be available. You are not required to redeem your accumulated rewards and/or benefits.
4.5 Neither accounts nor Program rewards, benefits and/or points may be transferred, shared or combined. Only the member paying for the products may accumulate rewards, benefits and/or points. We reserve the right to monitor the number of accounts per household and refuse, merge or close additional or duplicate accounts at any time. Your account information (including security details) are confidential and should not be shared with any other person.
4.6 Rewards, benefits and points earned through the Program have no cash value and you have no property rights in or to rewards or other Program benefits. Purchase balances and/or points credited to your Program account will be decreased or reversed, as applicable, if part or all of a purchase is returned or cancelled or if the credit is obtained through fraudulent or other activity that violates these Program Terms and Conditions. The sale, transfer, or assignment of any rewards or benefits offered through the Program, other than by us, is expressly prohibited.
4.7 Rewards cannot be exchanged or returned for points, another product or service or a monetary refund.
4.8 The products and services available through the Program and any samples that we may provide to you are for personal use only. You may not sell or resell any of the products, services, or samples you purchase or otherwise receive from us. We reserve the right, without notice, to cancel or reduce the quantity of any order to be filled and/or any products or services to be provided to you that we believe, in our sole discretion, may result in the violation of our Program Terms and Conditions.
4.9 We are not responsible for rewards, benefits and/or points lost or redeemed due to fraudulent activity by you or any third party.
4.10 We reserve the right to at any time change Program benefits, how you earn points and reach each Program tier and how we evaluate and reward your eligible purchases and/or other Program activity. We reserve the right to place limits on the number of purchases or activities that are eligible for the Program and/or for any given tier, the number or types of rewards or benefits you may receive or earn in any given tier, in a given time period or for the duration of the Program, and/or any combination thereof.
4.11 If you have concerns that a purchase or other activity was not properly applied to your account, you should contact Björn Borg customer service. Your email must specify your name and email address associated with the Program, the date of the Program activity, and the issue(s) you encountered. This email must be sent no more than forty-five (45) days after the date the purchase or other Program activity took place. We are not responsible for late notifications about purchases or other Program activities not being credited to an account.
4.12 Rewards can only be redeemed on the Site and in certain stores (specified by Björn Borg from time to time) and only with a product purchase, unless otherwise noted by Björn Borg.
4.13 Questions on applicable rules for the taxation of benefits within loyalty programs should be addressed to national tax authorities. Björn Borg accepts no liability for the individual member's tax obligations in connection with the Program.
5. PROGRAM COMMUNICATION
5.1 By enrolling in the Program, you will be automatically subscribed to receive and you consent to receive Björn Borg marketing emails, including Program-related communication.
6. TERMINATION & MODIFICATION
6.1 The Program and its benefits are offered at our sole discretion. We may, in our discretion, cancel, modify, restrict or terminate these Program Terms and Conditions, our FAQs and/or the Program or any aspect or feature of the Program at any time without prior notice, even though such changes may affect the value of rewards or benefits already accumulated or earned and/or the ability to redeem accumulated rewards or benefits.
6.2 We reserve the right to at any time and in our sole discretion, terminate your participation in the Program and to audit your membership account (subject to our Private Policy).
6.3 To keep your account active you must log in to your Program account and make a purchase or activity within 24 months.
6.4 If your membership is terminated, any rewards or benefits in your account will automatically expire and your access to the Program and features will automatically terminate. If we suspect illegal activity, fraud, misrepresentation, abuse or violation of these Program Terms and Conditions, we also have the right to take appropriate legal action, in our sole discretion.
6.5 If you decide you no longer want to be a part of the Program, you may terminate your membership at any time by opting-out of the Program in your account on the Site. If you terminate your membership, you will lose all accumulated points, benefits and tier status.
8. GOVERNING LAW
These Program Terms and Conditions shall be governed by the laws of Sweden.
The district court of Stockholm shall resolve any dispute that may arise out of these Program Terms and Conditions.
Any provision of these Program Terms and Conditions declared void or unenforceable by any competent authority or court shall, to the extent of such invalidity or unenforceability, be deemed severable and shall not affect the other provisions remaining which shall continue unaffected.
These Program Terms and Conditions replace all previous versions thereof.
